Go to The Rental Housing Tribunal and fill in a complaint form for unfair practice by your landlord. You will need to complete two forms: the main complaint form and the annexure (e) form.

Your rights as a tenant include:

not having the landlord enter the property without prior notice and approval, the right to dispute the lease agreement, and. the right to give notice and terminate the lease before it expires (which might lead to penalty costs).

In South Africa, a landlord cannot immediately evict you without following the due processes. If the landlord has formally cancelled your lease agreement and asked you to move out, and you do not, they can go to court to get an eviction order.

A landlord may not evict a tenant without a court order. Even if they aren't paying rent. Changing locks and cutting off utilities aren't allowed either. The landlord has to follow the proper legal procedure to evict someone.

Tenant's rights and responsibilities – utilities. Utilities are the additional charges which the tenant must pay. These amounts are paid over and above the rent, and both the tenant and landlord must agree upfront on which additional charge the tenant will pay: electricity, water, sewerage, refuse removal or parking.
